The attempt by a renowned social crusader and Economist, Prof Pat Utomi to establish a shadow government has been punctured as Justice James Omotosho of the Federal High Court in Abuja has declared illegal, unlawful, and unconstitutional the plan.

Delivering a judgement on a suit filed by the Department of State Services (DSS) against Utomi this Monday, 29/9/25, Justice Omotosho declared that the concept of a shadow government/cabinet is unconstitutional and alien to the nation’s presidential system of government.
The judge issued an order restraining the former presidential candidate and his associates from proceeding with their plan to establish a shadow government/cabinet in the country.
The High Court Judge made it clear that Prof Utomi and his associates cannot in anyway hide under the rights of association and to criticise the government to engage in unlawful activities.
Justice Omotosho however commended the plaintiff for filing the suit, agreeing that it was within the right of the DSS to take steps to prevent acts capable of threatening the nation’s internal security.
